A very passionate candidate who is anything other than a fake or what some like to call a politician.

Ray is not a Politician and this is a very very positive attribute.

Dont get me wrong he is very well suited for the Senate and the diplomacy is there but there is a sternness that demands his respect kind of like the respect and command he possesses in the classroom. I think we can all agree, if he can handle our youth in the classroom he will do well for us in Washington.

'Judicial hellhole' is junk journalism

I note the Dec. 19 publication of Mary Ann Cavazos' story "South Texas called a judicial hellhole for 6th straight year." Most reputable papers have stopped printing this garbage. It is strictly a spin document, released with little or no research, and is designed solely to influence future members of juries to vote for corporate and insurance interests, who fund the publishing of the document.

During this year, where the Rio Grande Valley and Texas Gulf Coast earned the second spot of judicial hellholes across the entire country, can you point me to a single eight-figure verdict in Corpus Christi or the Rio Grande Valley?

While I spent much of the year in a Senate race, and thus am not completely up to speed on the issue, I can find no one who can point me to a single million-dollar verdict this year in Corpus Christi. I can find no one who can point me to more than two such verdicts in the Valley this year.

There are more than 1.5 million people in the area covered by the silver medalist in this report. Instead of printing junk fiction pumped out by the PR machines of the American Tort Reform Association, perhaps the Caller-Times should focus its efforts on the good work that earnest, hardworking lawyers across South Texas are doing to protect the constitutional rights and safety of our citizens.

Ford Pintos exploding upon impact, Firestone tires falling apart in the Texas heat, Chrysler minivans ejecting belted children due to poor door latches, hundreds killed and injured at a BP refinery due to gross neglect by corporate chieftans, countless bad drugs pulled from the market because of no effective regulatory controls at the FDA and pharmaceutical companies decisions to place profits over patient's lives (Rezulin, Baycol, Fen-Phen, Vioxx), old ladies subjected to unnecessary second surgeries to replace tainted hip implants. The list goes on and on.

The citizens of the Valley and Gulf Coast have been victimized by poor decisions in corporate boardrooms, favoring greed over safety. Citizens serving on juries in Rio Grande Valley and Texas Gulf Coast have done their constitutional duty, and in doing this most honorable service, have protected their fellow citizens from the unkind actions of others, and have made our country a safer place.

Mass publication of the American Tort Reform Association's garbage is nothing but a veiled campaign by its funders -- large corporations and insurance companies -- to distort and deny common citizens of their right to an impartial trial by jury. This has grave constitutional implications, and discredits those great Americans and Texans who came before us.

In colonial America, the right of colonists to a trial by jury was abrogated by King George in the Stamp Act and the Navigation Act. Our forefathers rose up to secure this and other critical rights of citizenship. The denial of a right to trial by jury is the second grievance in our Declaration of Independence, second only to "taxation without representation." The right to a trial by jury, constantly under attack by the American Tort Reform Association, was fought for by George Washington and our constitutional founders.

It is demeaning to their legacies to print this garbage year after year after year, while ignoring the fine work our fellow citizens do every time they appear to fulfill their constitutional right and duty to serve on a jury in civil cases. When they listen to all the evidence in a court of law, their verdict should be respected and applauded. Instead, the verdict of 12 impartial citizens is slandered by monied interests in this country, who can count on corporate-owned newspaper chains to blindly print their garbage year after year after year. Shame on them and on the Caller Times for consistently agreeing to participate in carrying their water.

The irony of having a personal injury lawyer write this article just adds to the credibility of this report.

As a professional, non-lawyer who has suffered through jury duty and seen our local court in action, I can't say that Corpus is worse than other areas, but I can say that the judicial system is not about truth or justice, but it is about "winning" and "losing" and is something that angers one with integrity and a sense of moral right.

That article was right on the money and it doesn't have to be a "million dollar lawsuit" to ruin lives. The words “I’ll sue” seem to be what’s on the tip of everyone’s tongue these days, especially in CC.

By the way, out of the 42 million in that ONE suit how much did you get and how much for the “victim receiving justice”? That’s what I thought. Its lawyers like you with YOUR GREED that are the bigger problem to our judicial system.

The victims do indeed have an "absolute right" to trial by jury unless they have waived it.

BUT......

Lawyers do not have an absolute right to become millionairs by picking and choosing where they file the suits in hopes of finding sympathetic people that don't understand that when they make big awards for "pain and sufferings" that they are in effect engaging in "taxation without representation". The common ordinary people you "personal injury" lawyers claim you are trying to help and defend,, are actually the ones that end up paying..

All the injured person should be able to get is medical treatment and lost wages unless it can be shown that the injury was the result of willful neglect or malicious intent!!!!

All you lawyers should get is is what you claim you are trying to achieve. Justice for the injured and good reputations for helping the little guy. Your living should come from doing legal work that doesn't cause price inflation and restriction of the availabliity of doctors and medical services.

The framers of the Constitution never intended for the system to be distorted into the monster it now is where a business that uses a part that was made by another business (door latches) can be sued into near bankruptsy by being held financially responsable for the total liability even though they didn't know the part manufacturer was producing defective parts.

The framers of the Constitution certainly never intended for Doctors to be held responsable for injuries that occure during birth when the women had done nothing to ensure that their child would develop properly and in many cases had deliberately engaged in behavious that would result in sickness and/or disease and/or deformities of the child.

I just read an article about how specialist doctors are refusing emergency room calls because of fear of being sued. I don't really blame them.. Who in their right mind would be willing to show up in the middle of the night to do an emergency delivery of a baby for a crack addict knowing that there is a lawyer standing by looking for a target to sue.. How about the neurosurgeon that is called in the middle of the night to do brain surgery on the drunken motorcyclist that was riding without a healmet and again there is a lawyer waiting in the lobby to sue the doctor if the "victim" doesn't emerge good as new.

We need the English system where the loser pays all the court costs and lawyers fees and the defense has complete freedom to present evidence of culpability on the part of the "victim". This would do more to stop frivilous lawsuits that are used to intimidate good businesses and doctors into "settling" simply to avoid the possiblity of venue shopping and jury manipulation that may result in a lawyer buying a new ocean front house than any other reform that can possibly enacted.

Doctor's are still not policing their own to cut down on medical malpractice - and yes malpractice does exist. Automobile companies and other corporations have proven time and time again that unless the cost os the lawsuits which have been the results of people dying from their errors, outweighs the cost of the recall - they will not recall their products. Whatever evil we like to believe lurks in the chests of our lawyers - they have done a service to millions of people getting corporations to clean up their acts. I think we need to seriously question why it is so many no wish to put the corporations in the drivers seat - and throw out jurisprudence. Do I believe that our legal system should be considered a lottery ticket? No. But I do believe that careful and considerate juries are the answer.

There are very important reasons for lawsuits. Have you ever heard of the McWane Corporation? This Birmingham Alabama corporation, which bought Tyler Pipe & Foundry, is a poster child for corporate greed at the expense of employees lives & safety and environmental destruction and pollution.

Define "GREED!" If you define it as profit, a good return on their investment, you're right! Next, you need to define "SAFETY!" Some jobs are simply DANGEROUS! People know that when they take those jobs, and take them BECAUSE they're dangerous, because that also means the PAY is higher!

It's easy to use words such as "GREED" but I dare you to show many ANYONE who is in business for the FUN OF IT! It's easy to point to "SAFETY" as a concern, but isn't it HUMAN ERROR that causes most accidents in the work place? Who are those "HUMANS" who make the errors? Personal injury lawyers (like Mikal Watts) get FILTHY RICH! Isn't that GREED of the highest order? Aren't they getting RICH off the misfortune of the poor, working men and women?

40% of 42 million dollars is more than 16 MILLION DOLLARS! Do you really think he WORKED THAT HARD? How long and how hard would YOU have to work to make 16 MILLION DOLLARS? All your life and still be about 15 MILLION SHORT?

Corporations make a profit, that's what they're supposed to do, then distribute that profit to MILLIONS OF SHAREHOLDERS, a few hundred dollars to each. How many SHAREHOLDERS does Mikal Watts distribute his MILLIONS in profit to?

Invest your extra money instead of spending it on that new car, buy stocks in some MAJOR CORPORATION (like Valero) which turns a profit, so stock value increases, so you can someday retire and LIVE OFF THAT INCOME! That makes you part of one of those GREEDY CORPORATIONS Mikal Watts refers to, without which there would be no JOBS for any of the working people of the world to hold and make a living!

Of course, they wouldn't have many SAFETY concerns since fishing and/or picking wild berries are not usually very dangerous...

Amazing how so many are quick to give blame to doctors..... and believe that many of them deserve that is coming to them for malpractice. Granted there are many situations in which the physician is accountable for their actions due to negligence, but after working in the medical community and after having several dear friends in the medical field, it is apparent that our society is constantly looking for someone to be "accountable" and these ambulance chasers in our community are greedy and take advantage of so many with their ploys.

I have witnessed parents of premature infants, born at 24 weeks with major organ development issues and some that are dependent on drugs or have other issues to do neglect on the part of the mother. They expect the neonatal physicians and staff to perform miracles on these children. Their quality of life, what it may be, is very poor and the outcome is 85% not in favor of what our selfish society would like it to be. They want to "sue" the ob/gyn for not informing them of "something" in advance. They want to "sue" a geneticist for not letting them know of some malformation that may occur. Look at what TJH did..... OR attempted to do. SET UP SHOP ACROSS FROM DCH (Driscoll). He might as well have stood on the sidewalk as preemies were brought in and had a card placed on the isolet next to the child's information. IT IS PATHETIC HOW THEY PREY ON THE WEAK....

Sometimes, the world is just not "perfect".... sometimes things happen..... But in the litigious society of South Texas is wrought with attorneys that specialize in personal injury and medical neglect. Per capita, check out the local phone books if you don't believe, the attorney to resident ratio is out-of-control. It is an ego-centrinic world they reside in and as long as they get their $$$ it doesn't matter how well the individuals fair in the matter..... but then again only a personal injury lawyer would feel comfortable making money off another person's loss. Again... PATHETIC.

You're right, it does. The problem is, it's hard to find "balance" in our South Texas legal system.

A hospital gets sued because a Nurse gets kidnapped from their parking lot! That's balanced? No, it's STUPID, DERANGED!

Once upon a time, in the far, dim reaches of past memory, a JUDGE took a look at lawsuits to decide whether or not they had merit, tossed the frivolous ones in "File 13" and chastised the lawyer involved for filing them and wasting the courts time! How often does that happen in our legal system today? Isn't it a FACT that it occurs so rarely it makes big news when it happens? At the same time, lawsuit after lawsuit makes it's way through our courts when a little LOGIC would have short-stopped them before they ever got started.

South Texas certainly has no corner on stupid lawsuits but we have more than our fair share of them. One primary cause is the modern process is "Jury Selection." I once got called for jury duty where a chemical spill was involved, supposedly causing respiratory problems for a child. As soon as the attorney for the plaintiff learned I had knowledge of the chemical industry, I was dismissed. Why do you suppose that was? For starters, the "chemical" involved was ISOPROPANOL! For anyone who doesn't know, that's RUBBING ALCOHOL in it's pure form, before it's diluted with WATER and bottled for anyone and everyone to buy at the Grocery Store! Not exactly a chemical known for causing respiratory problem, especially not from a leaking drum in a storage building across the alley, especially not when the problem was found the DAY IT OCCURRED and cleaned up in accordance with OSHA standards.

Plaintiff Lawyers try very hard to weed out any juror who might actually understand what they're talking about, rather than having to accept their "SPIN" on some subject. This is counter-productive for a FAIR and HONEST hearing on the issue. It's dirt-common, throughout our legal system, just like "Court Shopping" to find some Judge who might be sympathetic to the plaintiff's cause. BOTH processes are designed to maximize damage awards, rather than to get a "Fair Hearing" on the complaint.

Find me a Nurse or a Doctor on a jury anywhere, involving medical malpractice! You can't! They won't be there because they would UNDERSTAND what happened, and the rest of the jury would LISTEN to them! Not a good situation for the plaintiff in most cases.

The list goes on and on. I could pontificate for HOURS and PAGES but I'll stop now. BALANCE is the last thing Personal Injury Lawyers ever want to find in the courtroom...

There's no better way to say it!

Tort Reform appears absolutely necessary, and yet already tainted with opposite extremes. The madness that represents our legal system reaches out to every avenue of basic life, and chokes out the understanding of Justice supposedly served. Not very many years ago, lawyers and the courts actually served Justice, and doctors actually practiced health conscious medicine too.

What about the corporate mentality of those two professions? What about the complacency that now occupies their minds to indoctrinate the matters of corporate level preservation into the professions involved? The only way to overcome indoctrinated, and incorporated corruption remains removing the opportunities available. It's been a long time since I have seen a doctor or a lawyer that is not intellectually preoccupied with systematic, cultural, or social stigmas. The professions are both inundated with such to the point of lacking purpose, benefit, and ethical credibility. Neither serves the basic needs assigned, and both appear to have abandoned basic principles.

A man died of asbestos poisoning after YEARS of being called a LIAR by DROVES of corporate minded doctors and lawyers. After his death, and autopsy, the lawyers couldn't wait to settle. Several cases directly related to his had been settled several years before he died. His should have too. Although the benefits to occupational related safety do serve over all justice, these types of trial lawyers and the reasons they exist very obviously do not.

Trial lawyers of these types are a breed created by corporate level preservation, and corruption. To overcome that, all levels of opportunity created by it need to be stopped. Let the corporate cards fall where they may, and when they are guitly as charged - rebuild on the ruins with the knowledge of obviously justified corporate failure. The courts are more than capable of calling corporate level legalities to order, and all levels of extensive, expensive, and repetitive delays need to stop.

A group of men who worked directly together should not have had to wait past the first occupational related death for obviously deserved Justice.

How dare Mr. Watts, or any other such corporately minded lawyer use the purposes of the lives like this man's to feed their own unethically produced legal system egos. May he and those like him take their intellectual stupidity right down to the unemployment office immediately.

Okay I will admit I have not read ALL posts but I read #15~ Yes the problem is there are individuals who prey on the weak and refuse to educate those that are ignorant. All the more reason South Texas needs a Law School.

It is unconscionable to say , oh well, "the world is not perfect" or "crap happens" because i suspect you would never stand up for what is just and "the right thing to do".

Medical Malpractice Insurance in Texas was so expensive, Doctors were once moving out and/or refusing to participate in hi-risk medical procedures. That's a fact, a documented statistic. A woman with a high-risk pregnancy couldn't find a Doctor to take care of her and her unborn child.

Texas passed a law which placed "limits" on the amount of money available for "pain and suffering" (not actual damages) under medical liability policies. The "COST" of such coverage started dropping almost immediately and Doctors started coming back, practicing medicine like before. They're still coming.

"High-Risk" patients can now get the medical treatment they need and deserve. That's a "POSITIVE" result for everyone who does NOT have a desire to "SUE WHOEVER IS AVAILABLE" (that would be most of us) in an attempt to get filthy rich playing "LAWSUIT LOTTO!"

The end result is positive for 99% of the people in Texas. Let the "LAWYERS" all move out-of-state, while the Doctors are encouraged to stay...

In the opening lines post 21 states "... the judicial system is not about truth or justice, but it is about "winning" and "losing" and is something that angers one with integrity and a sense of moral right."

I agree that the judicial system is not about truth and justice; however, I believe the motivation is more onerous then winning or losing. I believe it is about money, specifically the 40% contingency fee + expenses collected by lawyers. Many times they dont even have to do anything but file the suit because defendant insurance companies will settle to avoid the significant expense of litigation, despite the defandents lack of culpability.

In a law suit:
the plantif either gains or does not gain but loses nothing.
the defendants lawyer gains, if they prevail in the case, or loses their "expense" investment.
the defendants lawyer always gains.
the defendant always loses even if they win the case.

Law suits are set up to support the over abundance of lawyers found in most cities.

We do not need a law school we already have to many lawyers.

That is correct and most of the doctors will settle out of court rather than take a chance with a jury. That is why there are few mega-million dollar awards Mr. Watts. There are however, thousands of out of court settlements and that is why CC is a judicial hellhole. One bad ruling and the doctor is ruined for life. The lawyer who loses a case simply moves on to sue the next highly insured doctor. Most of your kind make me sick. YOUR GREED costs everyone a bundle. The cost of goods is driven sky-high by the cost of insurance needed to protect us, not from evil corporations but from blood sucking lawyers.

Of course it's about "money." That's what WINNING means in a civil suit, since no other penalty can be assessed by a civil court!

That's also why "TORT REFORM" is a legitimate way to minimize frivolous lawsuits!

A business (corporation) or an insurance company can afford to FIGHT BACK when the most they have to lose is a quarter million dollars. With the possibility of losing MULTI-MILLIONS they'd rather "settle" for some sum that won't bankrupt them and that's what plaintiff's attorney count on! A whole lot of lawsuits never get filed when the attorney knows he'll have to PROVE HIS CASE IN COURT because that's hard to do when you can't actually identify GROSS NEGLIGENCE on the part of the company being sued! (You know, like when someone pours HOT COFFEE in their own lap!)

With the possibility of Big Bucks out of the picture, no sane attorney will take a half-baked case to court on "contingency" so only legitimate claims get filed.

The legitimate claims deserve to be filed and heard. At the same time, civil suits were not intended to make someones extended family filthy rich so they still provide for REAL DAMAGES (no limit) which can be proved and that would include the loss of future earning capacity, so someone hurt and unable to work can get all their Doctor and hospital bills paid for the rest of their life, PLUS monthly insurance payments to replace their lost income if they can no longer work! An "Attorney" can't get his hands on any part of that. What they CAN'T collect anymore is "TEN MILLION DOLLARS" for pain and suffering! That little item is now limited to $250 thousand, and 40% of that sum doesn't make the lawyer filthy rich! The result is, since he'll probably also get a chance to PROVE the claim in court, most lawyers no longer file flaky lawsuits, which makes life cheaper and better for all the rest of us...

WASHINGTON - Karl Rove, President Bush's close friend and chief political strategist, plans to leave the administration at the end of August, the White House said Monday.

A longtime member of Bush's inner circle, Rove was nicknamed "the architect" by the president for designing the strategy that twice won him the White House.

"Obviously it's a big loss to us," White House deputy press secretary Dana Perino said. "He's a great colleague, a good friend, and a brilliant mind. He will be greatly missed, but we know he wouldn't be going if he wasn't sure this was the right time to be giving more to his family, his wife Darby and their son. He will continue to be one of the president's greatest friends."

“I just think it’s time,” Rove said in an interview with the Wall Street Journal published on Monday.

This morning I got a call that took me out on the streets. I needed a little punch so I put it on a Classic Rock Station expecting maybe some Hair of the Dog or War Pigs or maybe even Lovin You Sunday Morning or Proud Mary but it wasn't to be. I hear the end of a discussion with our Corpus Christi City Council Member stuck smack dab in the middle of that damn river.

Some begin to ponder, while there are others who know exactly where I am going with this River issue; after we finish with (this issue), Mr Mike Hummel will always remember to read the local internet and to give credit where credit is due.

You know with the Memorial Coliseum I have not the sentimentality or passion like many of you guys possess and concurrently I dont believe it needs to be torn down. I was against anything that TRT wanted to bring to this town in light of what they left us upon departure.

Some events and it might even be many events; cannot afford to use ABC Center; so it is not really a public arena like the Memorial Coliseum operated. Heck, many of us cannot afford to attend an event that is held in the ABC Center. So, tell us Mr. Hummel, Mr Burns and Mr Solis, will you make it affordable at least for our Local Goodwill Organizations like the Shriners to hold an event?

Currently, the ABC Center is out of our Local Goodwill Organizations reach because of price?

The discussion was about the Memorial Coliseum and specifically about the hiring of a consultant and if the City of Corpus Christi is going to follow WATT ever the Consultant recommended.

Corpus Christi City Councilman Hummel answered that the people have been included in the rounds of community input and public meetings.

The host asked if the Corpus Christi City Council was going to ask the consultant to include the input or if it will factor in.

Corpus Christi City Councilman Hummel quickly affirmed that the community's input has already been included.

The host then connected like Barry Bonds, Hank Aaron and the Great Bambino Himself; he asked Hummel if the Corpus Christi City Council is considering the input from all of the people at the Caller Times on the Coliseum issue?

Mike Hummel answers "I don't know anything about whats going on at the Caller Times".

The host says you dont know, you haven't read the article at the Caller Times about the Memorial Coliseum and the internet input and suggestions from the public, you arent going to consider that input?

It has been used for decades to keep objects from easily getting through the windshield and entering the vehicle. The negative is it prevent easy exit should one need to break the glass in order to escape in a submerged situation or something of that nature.

The resulting tumbling, sliding, shattering of glass, screaming, and bending of metal that happens in less than a minute (but feels like a lifetime) comes to a rest and there is a eerie silence for a moment. Three college girls are driving cross-country pulling a U-Haul trailer while simultaneously sharing a bag of marijuana. About 20 hours into the voyage, the driver brakes hard on a hill and loses control, sending the car off the side of the road.

They weren't wearing seat belts.

Was she high? Fatigued? Did she forget that breaking hard on a downslope while pulling a fully-stuffed U-Haul is a big no-no?

Whatever. Represented by Corpus Christi plaintiff's lawyer Mikal Watts in a suburban Houston courtroom, she demanded millions in damages over the accident-- from a tire maker.

No matter that Texas state investigators blamed the wreck on driver error and speeding, concluding the tires remained intact after the crash and worked just fine. Still, Watts argued they were wrong, that it wasn't her fault. He even demanded the judge declare a mistrial when the defense had the nerve to raise the girl's driving-while-pot smoking in court.

Is this the kind of guy-- one who would make such a specious, if self-serving, argument with a straight face-- that we want representing Texas in the U.S. Senate?

Mr. Watts, a 39-year-old mega-millionaire and judge's son who flies private, is traveling the state this summer, raising money and straining to re-define himself as a populist "everyman" in preparation for the Spring 2008 Democrat primary election.

He made his bones making arguments like the aforementioned, suing automakers and other businesses. But suffice to say, he won't be bragging on the campaign trail about the "marijuana mistrial" or his lawsuit blaming Ford for an accident in which the driver was speeding, had been drinking and wasn't wearing a seat belt.

The automaker was at fault because, according to Watts, it didn't laminate its side windows.

Watts will also remain mum about the embarrassing hiccup in that Ford case-- when it was revealed mid-trial that one of his associate lawyers was dating one of the jurors. She had even helped him "recruit" two of the plaintiffs for Watts, evidence showed.

Apparently under no ethical obligation to tell the court about this, Watts remained quiet and steadfast. It paid off-- he won a $31 million verdict.

"Mikal Watts has spent his entire career fighting on behalf of average, working Texans," promised his spokesman in a recent interview.

Don't believe it just because he says so.

Texans for Public Justice (TPJ) bills itself as an independent, non-partisan, watchdog group dedicated to exposing a system of financial contributions that it says is corrupting Texas politics. In fact, TPJ is nothing that it claims to be. It is not Texan. Nothing about it is public. And, it is definitely not interested in justice. A thorough look at TPJ’s activities reveals that this “watchdog” is just an attack dog. Although it describes itself as a watchdog public interest group, it appears to be little more than a de facto mouthpiece for plaintiff trial lawyers in this state and their statewide lobby organization, the Texas Trial Lawyers Association.

TPJ first appeared in Texas in 1997, when veteran operatives of leftist, out-of-state organizations – such as Ralph Nader’s Public Citizen – came to this state to set up the organization. The TPJ version of justice is one-sided. Since its inception, TPJ – preying on the good intentions of media outlets across Texas and this nation – has used an array of slanted, self-published reports to criticize a select segment of this state’s political spectrum. The targets of TPJ’s attacks are almost exclusively Republicans, business leaders and organizations, and those interested in the reform of Texas’ civil justice system.

Within those categories, TPJ attacks all levels of state government, ranging from former Gov. George W. Bush to the Texas Supreme Court, the Texas Attorney General, and the Legislature. While the subjects of the TPJ reports vary, the targets are always the same: Businesses, Republicans, Conservatives, Tort Reformers. Shockingly, this self-described watchdog group has never found anything worth reporting about the plaintiff ’s trial bar, or the politicians funded by trial lawyers. TPJ’s main mode of derision is a steady stream of reports targeting campaign contributions. Although there appears to be a growing recognition of the group’s partisan nature, the media generally treats TPJ as a public “watchdog” dedicated to documenting financial contributions and their role in political races.

Even a cursory review of TPJ reveals that its rancorous attacks are apparently motivated by a specific political agenda. Portraying a public persona that trades on good government and the public’s right to know, TPJ’s activities seem to indicate its unstated goal is to demonize business interests and any elected officials who support a pro-business agenda or who oppose frivolous lawsuits. In all its actions, TPJ consistently fails to disclose the depth of plaintiff trial lawyer participation in Texas political activities.

The targets of TPJ attacks and the timing of those attacks are further evidence of the group’s attempt to further the political agenda of that well-funded, sliver-thin section of the trial bar. In Texas, TPJ’s analyses, reports, press releases, and public statements all read like the Texas Trial Lawyers Association prepared them. They are anti-business and antijob creation. Everything they do seems to share an overarching theme: Texas would be a better state if it were easier to file lawsuits and there were more and broader opportunities to bring legal action. From its inception, one of TPJ’s prime targets has been Texans for Lawsuit Reform (TLR). TPJ’s inaugural report attacked Texans for Lawsuit Reform, people in the forefront of advocating a fair and balanced civil justice system, and individuals and businesses most closely associated with that bipartisan, nonprofit, statewide public policy organization.

TLR, which commissioned this report, has over 11,200 supporters in 610 Texas cities and those members represent 1,110 different trades, professions, and businesses. TLR is proud of its supporters, its mission, and its transparency. TLR has become the state’s leading civil justice advocacy organization. CORPUS CHRISTI - James Plaisted was a respected child psychologist, a deacon in one of the city's largest Baptist congregations and the father of four.

He also was a child molester so brazen he escorted little girls into church and fondled them under his coat while listening to the sermon.

Parents knew. So did church pastors, school officials and state regulators. But few did anything to stop him, and those who tried were remarkably unsuccessful.

It took 10 years to get Plaisted behind bars. Only he knows how many children he molested during that time.

Last month, Plaisted - already serving a two-year federal prison term for luring a Texas patient to Boston to continue molesting her -was brought back to Corpus Christi in chains.

He pleaded guilty to sexually assaulting four girls and was sentenced to 40 years in prison.

State regulators have yet to revoke his license to practice psychology.

""I think the Plaisted case is the model of what happens when the system fights with itself," said Susan Snyder, a Kingsville attorney and former prosecutor who tried to lock up Plaisted in 1992.

""Obviously, there have been safeguards in place to prevent this man all along, but either (state officials) were too lazy or too busy, or too scared of the politics of going and yanking this man's license," Snyder said. ""It's not the legal system failing. It's the people within the legal system that refuse to let the legal system work."

It's not as if no one tried.

Carmen Alvarado, the mother of the first child to accuse Plaisted more than 10 years ago, sought criminal charges against the therapist and filed an ethics complaint with the Texas Board of Examiners of Psychologists. She alleged that Plaisted had fondled her son's penis during a late-night counseling session.

Alvarado called the Parkdale Baptist Church, where Plaisted, 46, was a deacon.

""They said they were leaving it in God's hands," she recalled.

""I don't think they were thinking straight at the time."

She went to other parents. She got no help.

In the end, it was just her son's word against Plaisted, who told a Corpus Christi jury in 1986 that the 6-year-old child was a habitual liar and a pyromaniac who derived sexual excitement from setting fires. It didn't help that a new prosecutor was assigned to the case just before trial.

The jury acquitted Plaisted; his practice continued.

""It made me mad because when I went for help, all I asked was for them to testify," Alvarado recalled. ""We lost because my son was the only witness we had."

""It was a very tough call to make," said another victim's mother. ""And looking back, I really should have crucified him, but I didn't. I chose not to after talking to my attorney. He told me it would just really traumatize my daughter."

The Corpus Christi woman, who asked not to be identified, said she did confront Plaisted and his wife, who were neighbors in 1984, when her daughter was allegedly molested while spending the night with one of Plaisted's daughters.

""He did not deny it," she said. ""He said he could have done it

in his sleep."

Plaisted's wife laughingly added that she and her husband often made love at night, and he would not remember the next morning, the woman said.

The woman, who was also a member of the Parkdale Baptist Church, recalled telling church officials later about Plaisted's molestations.

""But it didn't seem to make any difference," she said. ""The church really backed him up, and a lot of people left the church after that."

Plaisted's attorney, Doug Tinker, refused to allow the Chronicle to interview his client. The criminal defense lawyer, who earlier this year represented Yolanda Saldivar, who was convicted of murdering Tejano star Selena, declined to discuss the Plaisted case.

The victims' families have since sued the church for negligence, but Parkdale's lawyer argues the congregation should not be held responsible for Plaisted's actions.

""It would be the church's wish to get this thing resolved without causing any additional hurt to anyone," said attorney Van Huseman. But he added, ""If a child gets molested in the middle of the service, how does that get to be the pastor's fault?"

Plaisted - a Nebraska native who served in the Army in Vietnam -came to Corpus Christi in 1982 with impeccable credentials, having earned his doctorate in clinical and child psychology from Auburn University in Alabama in 1981.

He quickly built a private practice, and over the years, developed a good reputation as an expert on brain dysfunction.

The Corpus Christi school district, along with local pediatricians, eagerly supplied him with young patients - even after he had been publicly charged. Members of the church also sought his help, and he had hospital privileges at the prestigious Driscoll Children's Hospital, a South Texas institution known both for quality care and charity.

Neighbors described Plaisted as pleasant, reserved, well-spoken. He was methodical, they said, and liked to work on projects around the house.

Plaisted recruited some of his victims from broken homes, showering the children with gifts, inviting them and their parents to Thanksgiving dinners. One 9-year-old girl who spent the night with Plaisted's daughter told prosecutors the psychologist molested her on the sofa in his living room while he and the children watched the movie "Home Alone"

on video.

He curried favor with his victims' parents by lending them money and refusing repayment, or by buying them air conditioners and other gifts. One mother even acted as a character witness for the therapist during the Alvarado trial, unaware that her own child was being molested.

""The bottom line is this guy had complaints filed against him at the psychology board - and they are serious - and the board doesn't notify the school about the complaints," said Jerry Boswell, director of the Citizens Commission on Human Rights, a group funded by the Church of Scientology (SEE CORRECTION) that documents cases such as Plaisted's. ""And the school is still referring children to this guy."

Corpus Christi school administrators said they used Plaisted infrequently for psychological testing of students, although school records and correspondence indicate he was a consultant from 1983 until he was indicted for child sexual assault in late 1992.

School administrators have identified records of five students referred to him for psychological testing between 1985 and 1992. There are no records prior to 1985.

School board President Henry Nuss, who has served on the board for seven years, said he first heard of the Plaisted case when he was contacted by the Houston Chronicle last week.

""We certainly should be more selective in who we're using," he said.

After Plaisted was charged in the Alvarado case in April 1986, Robert J. Garcia, the school district's special education director, wrote to the state psychology board to ask about the psychologist's record. The agency's executive director replied that Plaisted's license had been suspended, but because the psychologist was in the process of suing to get it back, he remained licensed to practice. The letter gave no details about the nature of the complaints.

""He was given a clean bill of health by the only agency that had anything to say about it," said Dr. Adrian Haston, a psychologist who coordinates the school district's psychological services, and who, years ago, shared an office with Plaisted.

Haston emphasized that none of the schoolchildren referred to Plaisted were molested. ""And we never had anything untoward, any problems of that sort," he said.

Asked why the district would risk using a psychologist once accused of being a child molester, Haston replied, ""This is something the district did, and you can ask the director of special education why."

Garcia said in a recent telephone interview that he could not remember whether he knew about the child molestation charges at the time he wrote to the psychology board.

""All I know is we asked for what his status was and they said he could still practice," he said. ""We knew he was under review, but we didn't know what for.

""Look, the state board of psychologists, they're the ones that allowed him to continue to practice," Garcia added angrily.

""If anyone should be asked as to why this guy was allowed to continue, it should be the state board of psychology."

Pressed for further details, Garcia abruptly ended the interview and hung up the phone.

Although Plaisted was acquitted in August 1986 in the Alvarado case, the psychology board continued its investigation and ruled in November of that year that Plaisted had violated professional standards.

The board officially suspended his license for two years, but said he would be allowed to resume his practice in three months.

Meanwhile, Plaisted challenged the suspension in state district court in Austin, arguing the psychology board had unfairly considered allegations that had not been introduced during his hearing, denying him the opportunity to defend himself against them. The judge agreed, and in January 1987 reversed Plaisted's suspension.

While the board was investigating Plaisted's case, they were contacted by Corpus Christi psychologist George Kramer.

Kramer, who had hired Plaisted in 1982 before Plaisted was licensed, told the board to subpoena records of the state Department of Human Resources. It did, and found other instances of alleged molestation by Plaisted.

In April 1989, the board reached an agreement with the psychologist that allowed him to keep his license if he agreed to be supervised for 11/2years. Plaisted was to treat children only in the presence of an associate or in a location where he could be observed by a television monitor. He also was to pay to have Corpus Christi psychologist Joseph Horvat supervise his casework.

Horvat met with Plaisted weekly, but after a year - convinced that Plaisted was doing nothing wrong - he recommended the supervision be terminated six months early. The board decided to continue the supervision.

""I have found no evidence in any way, shape or form of any behavior on his part which could be in any way construed as unprofessional or unethical," Horvat wrote to the board.

Included in one of his reports to the board was a review of Plaisted's treatment of an 8-year-old girl - a child Plaisted was later charged with molesting.

The board's general counsel, Barbara Holthaus, acknowledged past actions taken by the agency were inadequate.

""With hindsight, of course it wasn't appropriate, because look at what happened," Holthaus said. But she said the board has since added lay people to its ranks and has a new, tougher state law giving it better enforcement powers.

""Now, if we get a report that a psychologist is molesting a client, we can go before a judge and say we want to temporarily suspend the license," she said.

Holthaus said the board has filed a motion to revoke Plaisted's license, but Plaisted is fighting it.

""It's all kind of moot, because he's incarcerated," she said.

Soon after Plaisted completed his board-ordered supervision, Corpus Christi police received new information from state child welfare workers that Plaisted had been molesting girls at his office, in church and at home in his hot tub.

Former detective Eric Michalak, who now works in Colorado, remembered taking the Plaisted case to a Nueces County assistant district attorney for prosecution.

""He wanted to get a warrant for the doctor and arrest him, because we had very strong evidence against him," Michalak said. ""We had multiple victims and you had a guy in the position he was in, where he had access to all these victims.

You would want to take quick action rather than let it go on for so long."

The prosecutor was overruled by then-District Attorney Grant Jones, Michalak said. ""(Jones) just said, `We're not getting a warrant. We're taking our time.' He wanted the kids reinterviewed by one of the prosecutors.

""Any time you go after someone like that, there's a lot of politics that come into play," Michalak added. ""Instead of stepping in right then, and bringing it out in the open and taking it to a grand jury (for indictment), they delayed."

Jones contends that any delay in prosecution was an effort ""to tie the case down tight. We didn't want to lose him twice,"

said Jones, on whose watch Plaisted was acquitted in the Alvarado case.

Jones called it ""outrageous" the psychology board still hasn't revoked Plaisted's license.

""They should have done it in 1986," he said. ""What they want to do is wait around until you go to trial and you convict him, and then they come in behind your conviction and revoke his license. Well, what's he doing in the meantime? He could be out in the community molesting kids for two years."

Michalak said the case was finally taken to the grand jury several months later after he leaked the information about Plaisted's investigation to the local media.

""It was taking too long, and it wasn't being handled like another case," he said. ""And it was because he was so prominent in the community."

Plaisted was finally indicted in Corpus Christi in October 1992. He posted bond, closed his practice in Corpus Christi, and negotiated an agreement with the psychology board to place his license on inactive status until he could prove his innocence.

He then moved to Boston, where he enrolled in Boston University Law School and successfully completed his first year of studies by May 1994.

While in law school, Plaisted began calling a former patient - the girl whose treatment Horvat had reviewed in Corpus Christi. Plaisted convinced the girl's mother - who was also a patient of his - to bring the girl to Boston for additional therapy.

Plaisted's plans were foiled when a policeman setting up a speed trap in his neighborhood accidentally intercepted on his police radio a sexually explicit telephone call between the girl and Plaisted, who was using a cordless phone.

FBI agents were called in, six other calls were taped, and Plaisted was arrested on June 3, 1994, after he met the girl, then 13, and her mother at the train station and took them to a budget motel.

""The mother wasn't aware" of the molestations, said Adolfo Aguilo, an assistant Nueces County district attorney. ""The mother had a borderline personality disorder - she developed dependency on people -and unfortunately for her the person she developed a dependency on was Dr. Plaisted."

Sgt. Michael Harpster, a police detective from suburban Boston who helped arrest Plaisted, described him as ""very congenial, almost shy."

""He'd answer questions very courteously, but he didn't show any outward signs of knowing the seriousness of the situation," Harpster said.

Last January, Plaisted was sentenced by a federal judge in Boston to a two-year prison term after he pleaded guilty to transporting a minor across state lines to engage in illegal sexual activity.

The Corpus Christi conviction and sentence came almost a year later.

In the end, Plaisted admitted molesting four victims. But prosecutors say no one will ever know how many others failed to come forward.

""I imagine there could be several other victims. Through his practice and the church he probably had access over the years to thousands of children," said Aguilo, the Corpus Christi prosecutor who eventually secured Plaisted's guilty plea.

""To me, any kid that came in contact with this guy was a victim in some way or another," added Michalak.

When Plaisted was sentenced last month, it was a bitter emotional meeting for many of his young victims and their parents, who had been called as witnesses in case Plaisted decided against the plea bargain.

Parents said Plaisted stood up straight, held his head high and looked the judge in the eye. And when he saw the relatives of his former victims, he acted as if he were attending a reunion of old friends, they said. One parent said Plaisted looked as if he thought they were there as supporters or character witnesses.

""He turned around and gave the families a big smile," Alvarado said. ""I couldn't believe it."

Alvarado, who sued Plaisted in civil court, has received a settlement for an undisclosed amount. Her son, now a teen-ager, is still struggling with his past abuse, she said, and she continues to feel betrayed by those who would not join her in speaking out years ago.

""I told them if they had helped me in the beginning, none of this would have happened," she said.

CCISD: Why are CCISD Students allowed to run at large during school day hours?

Education is for our Children, our Youth, our Future. Children and Youth need constant redirection and set boundaries at home and at school as well. When a minor is allowed to run at large during the school day hours whether it is in the halls, leaving or returning a closed campus or simply unaccounted for is irresponsible of the caretaker whose custody in which he / she is placed.

An absent student is one who does not arrive at school in the morning and is absent for the WHOLE Day. The student was never on campus. The Parent is responsible for the student getting to school (requiring the student to attend school). If the student does not get to school it is the Parent’s responsibility not necessarily the Parent’s fault. There are circumstances where the student will walk in the front door and out the back door without attending a single class. This is where the attendance officers need to improve their due diligence like the old days.
Once the student is counted present in the morning; the Parent has required the student (child) to attend school. Once the student is verified in attendance at the beginning of the school day the student is in the custody of the School.
If the student is tardy or skips class (on campus or off campus) this happens on the watch of the school. The Parent if informed should cooperate and communicate with the School Counselors Administrators and the Attendance Officer to correct the behavior. The Security and Attendance officer should take notice and tighten the belt. This is a security issue as well; there is no excuse for students coming and going outside of the lunch period and it is imperative that attendance irregularities be dealt with within 24 hours. This is easily done with our modern technology.
Instead, what we are seeing is the Attendance Officers documenting the absences as they accumulate and filing on the Parent and student when the number of absences are achieved.

CORPUS CHRISTI - CCISD school board members interviewed five candidates Friday to fill the board position vacated by Reverend Harry Williams.

The school board said it will set another meeting to discuss the finalists, and will possibly make a decision then, but still no word on when that would be.

Williams served the school board for more than seven years before resigning last month.

Where is the criteria the process for "narrowing the list"?

The process the CCISD Board used is unethical and unfair. Every single applicant took the time to fill out an application, and the thought process for the letter of interest and update of their resume and references. For all intensive purposes this CCISD Board just threw that work product into the trash can while opting for business partners, friends cronies and industry allies.

It is not about the 5 selected it is about how the 5 were selected. It is not about Barrera or Prezas or Bill Clark or Lucy Rubio.

It is about a change of policy where policy is defined by processes of the past. Lucy is the only one with the guts to make the motion, "for the board to scrap the current process and start over. There was no second to the motion." Are there others in that room who agree with her, but politically, they are bound & gagged. The current process is in conflict with current policy. The current process is now a civil rights issue. Is that what CCISD wanted, another Cisneros v CCISD?

The trustees' refusal to lay out the cards is beyond irritating; it borders on the outrageous.

Particularly disturbing is the fact that three new trustees elected last year - Carol Scott, John Longoria and Dwayne Hargis, all of whom emphasized their intent to bring new openness to the board - appear to have bought into the mum's-the-word ethos that has dominated this exercise.

To be sure, they (and their colleagues) could, and should, reverse their field.

CORPUS CHRISTI - CCISD school board members have decided not to change their policy which forbids seniors who fail the TAKS from graduating.

One parent we spoke with Thursday said the policy didn't make sense, because while students who fail the TAKS test during the school year aren't allowed to take part in graduation ceremonies. The same doesn't hold true for summer school grads. They're allowed to participate in summer graduation ceremonies without knowing whether they passed the test.

The decision didn't sit well with some parents and students.

School board member Lucy Rubio had hoped to amend the policy, and allow seniors who failed the TAKS to at least walk in with their class during may commencement. But other school board members didn't agree.

After analyzing the recent events surrounding the resignation of CCISD Board Trustee Harry Williams (1 of 3 at large district positions); one thing IS clear. That one thing is Due Process (or lack of it). Immediately one's memory of search firm fiascos and the CCISD Board tool of choice, the Interim Superintendent buffer / scapegoat. The process was elaborate and ethical reasons or rule were claimed as the reason for the process.

Well, why such a rush fellas?

Why is the CCISD board in such a hurry to fill this position?

A Superintendent position and a Trustee position; one we wine, dine and lodge and the other we announce for applications for a month or so and "narrow the list down" from 20 to 5 in most expedient fashion. Now, making a long story short we have 20 candidates who invested their creative, intellectual and professional abilities into a work product they hope will be scrutinized by the Board and be successfully competitive. A good letter of interest comes only from the heart. The application is at times tedious but at least it is more objective than the TAKS. Updating one's resume and with a list of references most meaningful to the position and all of this for 15 to get thrown in the trash can and the 5 resumes remaining are to place on public display

Anne Armstrong is on the powerful elitist National Foreign Relations Committee and sits on the A&M Board of Regents (College Station) along with Guadalupe Rangel.

The King Ranch over the years has harbored a craving for the Kenedy land or at least to waste it and use it for their own benefit. Some how, the Armstrong invisibly controls the King Ranch who influences the KFATSO to do the dirty work using Kenedy Land. Let us see if we can connect the dots? JFK was assassinated in Dallas. At this time before JFK was murdered; Sarita Kenedy East had recently passed and KFATSO would have welcomed a "strong arm" as an advantage. The King Ranch Super-lawyers and political influence were furnished to KFATSO at that time to battle the high & mighty J Peter Grace for control. By the King Ranch lending a "strong arm" to KFATSO a reciprocity had to of occurred. Did Spellman provide the favor? Directly or indirectly, Spellman ordered the hit and in doing so favored the King Ranch? Why would the King Ranch off JFK? First, LBJ was their man and he was so close to the Oval office they could smell it. JFK did not align with the Good ole Boy system that already had plans to overthrow Castro after his changes affected corporate America. Sugar Cane prices went up & several Corporate Ranches were given back to the Cubans. JFK's refusal to go ahead with the planned invasion did not stop the invasion but many CIA Agents were killed or captured in the Invasion we know as the Bay of Pigs. Texas Physicians and Hospitals Join State Legislators to Ensure Texas Children Have Health Care Coverage

    AUSTIN, Texas, April 3 /PRNewswire/ -- Nearly 400 Texas physicians,
medical students, and hospital leaders rallied state legislators today to
pass legislation that would provide health insurance to thousands of Texas
children.
   Physician and hospital leaders from across the state joined state Reps.
Sylvester Turner (D-Houston); House Bill 109 author, John Davis
(R-Houston); Elliott Naishtat (D-Austin); and Patrick Rose (D-Dripping
Springs) to encourage their colleagues to pass HB 109. The bill would
restore 12 months of continuous coverage for kids in the Children's Health
Insurance Program (CHIP), establish a more realistic asset test for working
families, and remove the 90-day waiting period for uninsured children.
   Health care leaders believe restoring the cuts made to CHIP in 2003 is
a critical and important first step in reducing the number of uninsured
children.
 Texas has the highest rate of uninsured children in the nation --
1.4 million children -- 700,000 of these children are eligible for CHIP or
children's Medicaid but are not enrolled. "This is an embarrassment," said
Texas Hospital Association President and CEO Dan Stultz, MD. "Texas can,
and should, do better."
   "Texas simply can't afford to wait any longer to address its growing
uninsured population, especially when generous federal matching funds are
available for CHIP," said Texas Medical Association President Ladon W.
Homer, MD.
   Since 1998, Texas has forfeited more than $900 million to other states
because we haven't used all the federal CHIP funds available to our state.

Children's Medicaid and CHIP return Texans' tax dollars to the state. By
using these programs to insure more Texas children, Texas can stretch
limited tax dollars. For every dollar Texas invests in Medicaid, the
federal government returns $1.54. The federal match for CHIP is even more
generous -- $2.63 for every dollar Texas invests.
   High rates of uninsured Texans create higher taxes and health care
costs for businesses, taxpayers, and those fortunate enough to have health
insurance. Dr. Homer added, "It's important state legislators recognize
that gaps in health care coverage, even for a short period of time,
undermine the health and well-being of children." More than 70 percent of
children who lost CHIP or children's Medicaid became uninsured.
   When children do not have health insurance, they are less likely to
receive preventive health care. Their families often rely on community
emergency departments for their medical care. Without the benefit of the
federal CHIP or Medicaid matching dollars, local taxpayers end up paying
the full costs of caring for uninsured children.
   However, lawmakers can make a difference with their vote today and
during the next 60 days by passing legislation to capture federal dollars
and provide hard-working parents an affordable way to insure their
children. "CHIP is good medicine for Texas children and good for Texas
business," said Dr. Homer.

restoring CHIP cuts so that hard-working Texas families have vital health
care services.

Thank you for your response to the issues with Section 25.093 of the Education Code. Truancy is indeed a serious concern for myself as a parent and for our community as a whole. If you remember it was a very heated issue during the Precinct chair election in which Kenedeno & Associates, in combination with your attributes and network that brought fairness and balance to the unleveled field. It was the written word that reached the precinct chairs. It was the written word that allowed them to become informed and make up their own minds. And it was the written word that provided the security and comfort zone to vote the way they felt was appropriate. The Miller issues revolved around this law and it was the Principal and his administrators who were blamed.
Unequivocally, when a parent places his child in the custody of a School Administration: The Parent requires the child to attend school if the child is present at beginning of the day!

TEXAS EDUCATION CODE Sec. 25.093 & 25.094 is derived from the TEXAS EDUCATION CODE Sec. 4.25. Thwarting Compulsory Attendance Law which stated,
(a) If any parent or person standing in parental relation to a child, within the compulsory school attendance ages and not lawfully exempt or properly excused from school attendance, fails to require such child to attend school for such periods as required by law, it shall be the duty of the proper attendance officer to warn, in writing, the parent or person standing in parental relation that attendance must be immediately required. If after this warning the parent or person standing in parental relation intentionally, knowingly, recklessly, or with criminal negligence fails to require the child to attend school as required by law, the parent or person standing in parental relation commits an offense. The attendance officer shall file a complaint against him in the county court, in the justice court of his resident precinct, or in the municipal court of the municipality in which he resides. An offense under this section is punishable by a fine of not less than $5 nor more than $25 for the first offense, not less than$10 nor more than $50 for the second offense, and not less than $25 nor more than $100 for a subsequent offense. Each day the child remains out of school after the warning has been given or the child ordered to school by the juvenile court may constitute a separate offense.

It appears in 1989, Section 4 of the Texas Education Code was amended (avoiding the public radar) into a idealistic “mission statement” rendering it a toothless but altruistic statement.
ch. 658 § 11, 1989 Tex Gen. Laws 2165, 2168, amending § 4.25, Education Code (Thwarting Compulsory Attendance Law)

The incorporation of the Compulsory Attendance Law and the Thwarting thereof into Section 25 “Admission, Transfer and Attendance” excluded the “intentionally, knowingly, recklessly, or with criminal negligence” qualifier. Also, please take notice of the fine amounts clause “not less than $5 nor more than $25 for the first offense, not less than$10 nor more than $50 for the second offense, and not less than $25 nor more than $100 for a subsequent offense”.
An absent student is one who never arrives at school in the morning and is absent for the WHOLE Day. The student was never on campus. The Parent is responsible for the student getting to school (requiring the student to attend school). If the student does not get to school it is the Parent’s responsibility not necessarily the Parent’s fault. There are circumstances where the student will walk in the front door and out the back door without attending a single class. This is where the attendance officers need to improve their due diligence like the old days.
Once the student is counted present in the morning; the Parent has required the student (child) to attend school.
Once the student is verified in attendance at the beginning of the school day the student is in the custody of the School.
Is the Parent, by taking the child to school (and the child is accounted for as in attendance), “intentionally, knowingly, recklessly, or with criminal negligence failing to require the child to attend school”?
When the student is tardy or skips class (on campus or off campus) it is happening on the watch of the school. The Parent should cooperate and communicate with the School Counselors Administrators and the Attendance Officers to correct the behavior.
The Security and Attendance officers should take notice and tighten the belt. This is a security issue as well; there is no excuse for students coming and going outside of the lunch period and it is imperative that attendance irregularities be dealt with within 24 hours. This is easily done with our modern technology. Instead, what we are seeing is the Attendance Officers documenting the absences as they accumulate and filing on the Parent and student when the number of absences are achieved. (Like to meet a quota.)
Below are a few excerpts out of the legislation from the 74th Legislature authored by Bill Ratliff
“7-23 (2) the unexcused voluntary absence of a child on 10
7-24 or more days or parts of days within a six-month period or three or
7-25 more days or parts of days within a four-week period from school
7-26 without the consent of his parents”;
That is called a permission slip where I went to school. The HD #33 State Rep and the South Texas Delegation need to do what is best for South Texas. Make a law like the

“5-11 (15) "Status offender" means a child who is accused,
5-12 adjudicated, or convicted for conduct that would not, under state
5-13 law, be a crime if committed by an adult, including:
5-14 (A) truancy under Section”51.03(b)(2);”

“50-6 (d) 3) the person child and the person's child's
50-7 parents, managing conservator, or guardian attend a class for
50-8 students at risk of dropping out of school designed for both the
50-9 person child and the person's child's parents, managing
50-10 conservator, or guardian;”

“(e) An order under Subsection (d)(3) that requires the
50-22 parent, managing conservator, or guardian of a person to attend a
50-23 class for students at risk of dropping out of school (d) of this
50-24 section is enforceable in the justice court by contempt.”

“ 52-19 (2) the child's parents, managing conservator, or
52-20 guardian attend a parenting class or parental responsibility
52-21 program if the court finds the parent, managing conservator, or
52-22 guardian, by wilful act or omission, contributed to, caused, or
52-23 encouraged the child's conduct; or
52-24 (3) the child and the child's parents, managing
52-25 conservator, or guardian attend the child's school classes or
52-26 functions if the court finds the parent, managing conservator, or
52-27 guardian, by wilful act or omission, contributed to, caused, or
53-1 encouraged the child's conduct.”

“60-12 (g) On a finding by the court that a child's parents or
60-13 guardians have made a reasonable good faith effort to prevent the
60-14 child from engaging in delinquent conduct or engaging in conduct
60-15 indicating a need for supervision and that, despite the parents' or
60-16 guardians' efforts, the child continues to engage in such conduct,
60-17 the court shall waive any requirement for restitution that may be
60-18 imposed on a parent under this section.”

a reasonable good faith effort

144-3 (2) the unexcused voluntary absence of the child on 10
144-4 or more days or parts of days within a six-month period or three or
144-5 more days or parts of days within a four-week period from school
144-6 without the consent of the child's parent, managing conservator, or
144-7 guardian;

145-17 (b) A parent, managing conservator, guardian, or other
145-18 member of the child's household who violates a court order under
145-19 Section 264.305 by failing to participate in services provided by
145-20 the department is subject to contempt of court. The court may
145-21 under its contempt powers impose a community service requirement.”

Furthermore, 74R SB 1 was authored by Senator Ratliff; while the Sponsor was Sadler. In this legislation, the term Recalcitrant Person cogently replaced the “intentionally, knowingly, recklessly, or with criminal negligence failing to require the child to attend school” Parent.
“464-14 (7) , or to file a complaint against any
464-15 recalcitrant person having parental control as provided in Section
464-16 25.090; and
464-17 (8) 4.25 of this code, or to file a complaint
464-18 against a student pupil for a violation of Section 25.091”
In response to your statement, “You say that you are doing everything you can to require your child to attend school and feel that you are being prosecuted unjustly”.
This is not about me Solly, I have the ability to defend myself and I will do so eloquently in a very public manner. I am presenting you with an unjust law, a law that injures many of your constituents and many of your esteemed colleague’s constituents as well. I am also providing you an insight as one who has attended public school and graduated from public school right here in Corpus Christi (CCISD).
However, the 74th Legislature decided that the best way to compel a child's attendance was to put pressure on the parent. While I understand the difficult and frustrating situation you are in, 1 also respect the 74th Legislature's policy decision and will not be filing any legislation regarding this issue at this time.
It is not the best way but the most expedient. As defined by your own words Solly, “(You) respect the 74th Legislature's policy decision”, it is requested that the cogent qualifier “Recalcitrant Person” be put back into the law.
As far as the JP Courts are concerned, an Attorney was consulted; the District Attorney; he has issued a directive to the JP’s consistent with the law. JP’s are not legally trained and have not the power to confine. Awaiting your response I remain.
